PayLinker Terms and Conditions of Sale
These terms and conditions (“Terms”) govern access to and use of the PayLinker service by any business customer. By creating an account or using the service, the customer confirms they have read, understood and accepted these Terms.
PayLinker provides a SaaS service to generate payment links and monitor payments. It is not a payment institution or an e-money issuer.
All payment flows are processed by Stripe, the payment service provider, under its own contractual terms. Funds are paid directly to the customer’s Stripe and/or bank account; PayLinker never holds the funds.
1. Definitions
In these Terms, the following terms have the meanings set out below:
- "Service": the PayLinker platform used to generate and send payment links (including by SMS) and monitor payments.
- "Customer": any business (individual or entity) using the Service to collect payments for its activity.
- "User": any person authorised by the Customer to access the Customer’s PayLinker account (employee, partner, contractor, etc.).
- "End recipient": any person (a customer of the Customer) receiving a payment link generated through the Service.
- "Stripe": third-party payment service provider handling payment processing on behalf of the Customer.

3. Scope
The Service is intended solely for professionals acting in the course of their business (commercial, craft, liberal or non-profit). The Customer confirms they use PayLinker as a business and not as a consumer.
These Terms prevail over any other Customer document (purchase terms, order form, etc.) unless otherwise agreed in writing by PayLinker.
4. Service description
PayLinker provides an interface enabling the Customer to:
- create payment links for amounts set by the Customer;
- send those links, including by SMS, email or any other channel chosen by the Customer;
- offer, when available, payment in 1 to 4 instalments via Stripe;
- track payment status and generate downloadable receipts.
PayLinker is not involved in the contractual relationship between the Customer and its own clients. The Customer remains solely responsible for its services, pricing, refunds, cancellations and its own terms and conditions applicable to its clients.
PayLinker provides SaaS payment tools for professionals and does not sell any physical goods; no merchandise return policy applies.
5. Account creation and access
- The Customer creates an account by providing accurate, complete and up-to-date information (identity, contact details, business status).
- The Customer is responsible for keeping its credentials confidential and for any use of the Service through its account.
- The Customer must immediately notify PayLinker of any fraudulent or suspicious use of the account.
- PayLinker may refuse or suspend an account in case of serious doubt regarding the Customer’s identity, integrity or regulatory compliance (fraud prevention, AML, etc.).
6. Plans, pricing and invoicing
Applicable prices (subscriptions, SMS credits, any additional fees) are those in force on the subscription date, as shown on the website or in the customer area.
- Pay-as-you-go plan: usage billed per action, notably based on SMS/transaction volume according to the published price grid.
- Pro plan: monthly subscription including benefits (SMS pricing, extra options, priority support, etc.) whose content and price are detailed in the customer area and may evolve.
- Stripe fees: payment processing commissions and fees are set by Stripe. They are separate from amounts due to PayLinker and remain fully borne by the Customer.
Unless stated otherwise, prices are shown before tax. Invoices are issued in the Customer’s name using the information provided at sign-up.
7. Payment and late payment
- Subscriptions are payable in advance for the relevant period. Pay-as-you-go usage (credits, SMS, etc.) may be billed on purchase or at period end depending on the chosen plan.
- In case of late payment, PayLinker may suspend access to the Service until all amounts due are settled, without prejudice to any statutory late fees and recovery costs.
- No unilateral set-off may be applied by the Customer without PayLinker’s prior written consent.
8. Refunds and disputes relating to the PayLinker service
Amounts paid by the Customer for paid subscriptions and SMS credit packs are definitively earned by PayLinker and are not refundable, except where required by mandatory law or in the event of a malfunction solely attributable to PayLinker and duly demonstrated by the Customer.
If there is a dispute regarding billing for the PayLinker service (subscription, SMS credit usage, ancillary fees), the Customer agrees to first contact PayLinker support at contact@paylinker.fr and set out the claim. PayLinker will review the request within a reasonable timeframe and may, at its sole discretion, offer an adjustment, credit note or goodwill gesture if appropriate.
This clause is without prejudice to the legal rights the Customer holds under French law and, where applicable, any mandatory provisions in the Customer’s country of residence.
9. Term, termination and suspension
Unless stated otherwise, subscriptions are entered into for an indefinite period with monthly billing.
- The Customer may terminate or suspend the subscription at any time from the customer area. Any period started remains due.
- PayLinker may immediately suspend all or part of the Service, without notice, in case of manifestly fraudulent, unlawful or non-compliant use of the Service.
- PayLinker may terminate the contract with reasonable notice, except in case of serious breach by the Customer justifying immediate termination.
10. PayLinker’s role and liability
PayLinker provides technical tools to generate and track payment links. PayLinker is not a party to contracts between the Customer and end clients, nor is it responsible for:
- the existence, quality or compliance of the services provided by the Customer;
- commercial disputes, cancellations, refunds or chargebacks between the Customer and its clients;
- decisions or policies of Stripe (account approvals, fund holds or payout timing, etc.).
PayLinker uses reasonable means to ensure Service availability and security, without guaranteeing a specific result. The Service may be temporarily interrupted for maintenance, updates or technical incidents.
If PayLinker’s liability is engaged, it is strictly limited to the amounts actually paid by the Customer for the Service during the twelve (12) months preceding the event. PayLinker shall not be liable for indirect losses (loss of revenue, loss of opportunity, reputational harm, etc.).
11. Customer obligations
- The Customer uses the Service in compliance with applicable laws and regulations (including consumer law, banking law, AML and GDPR).
- The Customer ensures its own clients are properly informed of the Customer’s sales, cancellation and refund terms and of any specific conditions related to the services sold.
- The Customer must not use PayLinker for illegal, misleading, dangerous activities or those expressly prohibited by Stripe or regulation.
- The Customer indemnifies PayLinker against any claim, judgment, cost or damage resulting from misuse of the Service or breach of legal obligations.
12. Payment processing and PayLinker’s role
PayLinker provides professionals with a technical interface to generate and send payment links to their own end customers. Card payments, including any instalment payments, are fully processed by the payment service provider Stripe.
Funds from transactions are paid directly into the professional’s Stripe account and/or the bank account linked to Stripe. PayLinker never holds funds belonging to end customers and does not collect payments on behalf of professionals.
When split-payment options (e.g. 2x, 3x or 4x) are offered, they are provided and assessed solely by Stripe, subject to cardholder eligibility and Stripe’s own rules. PayLinker does not provide credit, does not grant loans and does not act as a bank or credit institution.
13. Stripe and payment flows
To collect payments, the Customer must have a Stripe account that meets Stripe’s requirements. The payment services agreement is concluded directly between the Customer and Stripe; PayLinker is not a party to it.
- PayLinker does not control payout timing, fund holds or compliance decisions made by Stripe.
- The Customer remains solely responsible for checking applicable Stripe fees and their impact on the Customer’s own pricing.
- The Customer must comply with Stripe’s onboarding policies, KYC checks and all regulatory obligations imposed by Stripe.
14. Personal data
PayLinker processes personal data to provide the Service (account management, sending links, tracking payments). Full details of processing, data subject rights and security measures are set out in the Privacy Policy available on the site and in the app.
15. Intellectual property
The Service, its interface, trademarks, logos, texts, graphics and features are owned by PayLinker or its partners and are protected by applicable law. Any unauthorised reproduction, adaptation or exploitation is prohibited.
16. Force majeure
Neither party shall be liable for failure resulting from a force majeure event under French law (including large-scale internet outages, major cyberattacks, government decisions, natural disasters, etc.).
17. Changes to the Terms
PayLinker may amend these Terms at any time to reflect the Service or legal and regulatory changes. The Customer will be informed of changes by any appropriate means (email, in-app notice, website update). Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
18. Governing law and jurisdiction
These Terms are governed by French law. Any dispute relating to their validity, interpretation or performance shall be submitted to the courts with jurisdiction over PayLinker’s registered office, notwithstanding multiple defendants or third-party claims.
